Material Applicability

The Act's material scope is defined by four key factors: Automated Means Criterion, Filing System Criterion, Prospective Filing System Inclusion, and National Security and Law Enforcement Exemption.

Automated and Manual Processing

Act No. 77/2000 Art.3(1):

"The Act applies to any electronic processing of personal data. The Act also applies to manual processing of personal data that form, or are intended to form, a part of a filing system."

The Act covers two main types of processing:

  • All electronic processing of personal data
  • Manual processing when data is part of, or intended for, a filing system

National Security and Law Enforcement Exemption

Act No. 77/2000 Art.3(2):

"Articles 16, 18–21, 24, 26, 31 and 32 of the Act do not apply to processing of personal data that concern public security, national defence, State security and the activities of the State in areas of criminal law. The Act does not apply to the processing, by an individual, of personal data that only relates to the individual himself or is purely intended for personal use."

This provision establishes:

  • Partial exemption for state activities related to public security, national defense, and criminal law
  • Complete exemption for personal/domestic processing
  • Specific articles (16, 18-21, 24, 26, 31, and 32) do not apply to security and law enforcement activities
